. >>> one group definitely profiting from the obama care mess, lawyers. the health plan is once again being dragged into court. correspondent shannon bream is here with that story. tell us about this latest challenge. >> reporter: today in federal court in washington this is a lawsuit about the text of an irs regulation stemming from the overall health care law. the plaintiffs in this case say the text of the law says those subsidies that go out to help people buy insurance are only supposed to be given out in states that have set up their own state exchanges and not into states where the federal government is the one operating the exchange. the irs says not. so according to the agency's interpretation those subsidies go to applicants in every state. that is a huge distinction. it's very important. because where the subsidies are awarded, that triggers massive costly mandates for the employers. they wouldn't have otherwise. that's why they're suing. they say the costs will force them to cut employee hours, stop hiring, maybe even go out of business. they say this is just another example of

the beginning of the obama care debate i've been telling you it's not the cost of the health insurance that will be the main problem. yes, the cost is going to go higher for working americans, no question, but it is access to doctors that will vex americans in the future. in the next five weeks millions of americans will be added to the medicaid rolls. next year the congressional budget office predicts that 9 million more people will be receiving medicaid. just 69 percent of american doctors accept medicaid now. that number may go lower as government payments drop. if millions are added to the medicaid rolls and two-thirds accept those patients, the lines are going to be all over the place. joining us from oklahoma city, dr. keith smith who has a surgery practice and dr. brooks. dr. brooks, you don't take medicaid health insurance at all, correct? >> that's correct, bill. >> why? >> i don't think i can do a thorough job. i don't believe in running people through my practice. i don't believe in volume practice and the new laws really would necessitate my pushing people through, not doin

which is just one more failure of the obama health care law. bill: does that explain why the premiums are going higher? why the deductibles are going higher? so you get the middle class to pay for the medicaid expansion? >> well that is a big part of this goal of the president's health care law is to get young, healthy people, to buy much more insurance that they need or want or will ever use to pay for other people's coverage but sure looks like those young people are not going to be signing up because they have seen through what the president is tried to do here. i think all across the country people are being hit with higher premiums, higher deductibles. front page story today in the "wall street journal", that the deductibles on average are much higher, over $5,000 per person if they buy the least expensive of the policies on the exchange, the so-called bronze exchanges. people that are going to do comparative shopping are going to find this health care law that president obama has offered them is not a good deal. many people feel they will be pay more, getting less. i was back in
